Pistor v. Ursua-Riding - 2024 BCCRT 1104 - 2024-10-31
Small Claims Decisions - Final DecisionWithout lights, the trailer was unsafe to tow, so they hired Roadway Towing to tow it to their home for $294.14. None of this is disputed, and it is consistent with Mr. Pistor’s contemporaneous texts to JR. [...] In any event, when Mr. Pistor, a few minutes after the purchase, tested the lights and found they were not working, he called JR. It is undisputed that JR said she and Mr. Ursua-Riding had never actually towed the trailer, so they did not know whether the exterior lights worked. [...] 38. As noted, Mr. Pistor towed the trailer away, and there is no expert evidence that the trailer was structurally unsound or dangerous.

Crabtree v. 1839928 Ontario Limited dba Audi Of Victoria - 2021 BCCRT 822 - 2021-07-28
Small Claims Decisions - Final DecisionMr. Crabtree claims $3,873.48 for a used engine replacement, $110 in towing fees, $167.64 in legal fees, and a refund of the $143 inspection fee. [...] a. Whether Audi Victoria failed to adequately inspect Mr. Crabtree’s car as agreed, and if so, must Audi Victoria pay Mr. Crabtree for an engine replacement, towing fee, and legal fees, caused by its failure? b. Is Mr. Crabtree entitled to a refund of the $143 inspection fee? [...] I dismiss Mr. Crabtree’s claim for $3,873.48 for a used engine replacement and $110 in towing fees. I also find that Audi Victoria’s inspection was as agreed and was not deficient, so I dismiss Mr. Crabtree’s claim for a $143 inspection fee refund.

Levine v. The Owners, Strata Plan BCS 136 - 2021 BCCRT 76 - 2021-01-21
Strata Property Decisions - Final Decision19. Bylaw 32.1 provides that all vehicles parked in visitors parking must be registered and have proper insurance displayed or will be towed at the owner’s expense. 20. The Preamble to Bylaw 32.1 says that “...visitors parking is also meant for visitors only and not designated for owners storing their uninsured vehicles.” [...] 23. In terms of enforcement of visitor parking restrictions, on November 1, 2019, the strata circulated a notice to residents informing them that all vehicles in visitor parking stalls must display a Pass during specified times or be towed. 24. The strata provided copies of several parking infraction notices it issued in [...] I find that these notices, as well as a series of strata council meeting minutes going back to 2006, prove the strata was regularly reviewing vehicles parked in visitor parking and arranging towing for those that did not display a Pass. 25. The strata also provided some photographs showing available visitor parking spaces,

Knowler v. The Owners, Strata Plan NW 2762 - 2024 BCCRT 580 - 2024-06-21
Strata Property Decisions - Final DecisionHowever, among other things, bylaw 23 says vehicles parked in areas not authorized for parking will be towed. 16. The strata asserts that in 2020, when Mr. Knowler was the strata council treasurer, they increased the rental fee for additional parking stalls to $30 per month without a vote by the owners. [...] 19. Mr. Knowler admits their spouse paid the invoice on April 29, 2023 “to avoid any inconveniences from being towed”. I find the payment was made on Mr. Knowler’s behalf. Mr. Knowler also says they were concerned about not being able to vote at the upcoming May 2023 AGM. [...] 30. Based on the content of the strata’s March 30, 2023 letter, I find it reasonable, and I accept that Mr. Knowler’s spouse paid the strata’s $390.00 invoice to avoid having their vehicle towed. For these reasons, I find the strata must reimburse Mr. Knowler $390.00.

Couture-Noronha v. Southpaw Rentals & Sales Inc. - 2023 BCCRT 955 - 2023-11-06
Small Claims Decisions - Final DecisionWith Mrs. Couture-Noronha’s approval, on February 11 Southpaw towed the Rav4 to a nearby Toyota dealership (Toyota dealership 1) to complete the repairs. [...] Southpaw also claims $250 to fill the gas tank, $500 to have the vehicle cleaned, $612.50 for towing, and $61.25 for a towing fuel surcharge. 28. Mrs. Couture-Noronha says on March 8, 2022, she accidentally reversed the loaner truck into a parked vehicle. [...] 31. I also find Southpaw has not proven that the truck was returned with an empty tank (or provided with a full one), that it was returned dirtier than it was lent out, or that Southpaw incurred any expenses cleaning or towing the truck. I dismiss Southpaw’s counterclaim entirely. Interest and CRT fees

Ma v. 1059637 B.C. Ltd. - 2025 BCCRT 502 - 2025-04-23
Small Claims Decisions - Final DecisionShe also claims a $1,000 tow fee, and $1,500 for accommodation. Jia Ma says that as the damaged panel is in her trailer, her family will require alternative accommodation while the trailer is towed to a repair shop. [...] Considering the extent of the damage is small, I would not have found the tow and accommodation expenses reasonably foreseeable. 17. Under section 49 of the CRTA, and the CRT rules, a successful party is generally entitled to the recovery of their tribunal fees and dispute-related expenses.

In a civil dispute such as this, an applicant bears the burden of proof on a balance of probabilities. Beattie v. Carlaw Holdings Ltd. (dba McGibbon’s Auto & Truck Repair) - 2025 BCCRT 446 - 2025-04-09
Small Claims Decisions - Final DecisionThe remaining amount was for towing the truck to Carlaw’s shop and $552.11 in GST. 12. The truck ended up needing more work than anticipated, so Bruce and Doug verbally agreed to further work. [...] In the letter, the Beatties agreed to pay the balance of the original $13,200, $129.15 for the initial tow, $2,500 for the turbocharger, $1,800 for the fuel injectors, and $2,541.80 for the differential. [...] So, I find the towing charge is valid. 19. For these reasons, I dismiss the Beatties’ $2,500 claim.

Herrington v. Ternowski - 2025 BCCRT 401 - 2025-03-28
Small Claims Decisions - Final Decision2. Tyler Herrington says Jacqueline Michelle Ternowski slashed his car’s tires.[1] Mr. Herrington says as a result, he missed two days of work, and had to pay for towing and four new tires. He also says Ms. Ternowski shoveled snow onto his walkway and in front of his car. [...] Mr. Herrington claims $3,000 for lost wages, tire replacement and towing expenses, and emotional distress. 3. Ms. Ternowski denies slashing Mr. Herrington’s tires. [...] 15. Even if Mr. Herrington had proven it was Ms. Ternowski who slashed his tires, he did not submit evidence of his lost wages, or towing and tire replacement expenses. So, I would not have awarded him the full amount he claims in any event.

Ryan v. Surrey E-Bikes - 2022 BCCRT 28 - 2022-01-11
Small Claims Decisions - Final DecisionMs. Ryan ultimately refused because she did not want to pay for the tow and she said she had no way to get the E-Bike back to SEB. I find there is insufficient evidence that SEB was reasonably obligated to up-front pay for the tow to bring the E-Bike back to SEB for inspection and possible repair. [...] There is also no evidence before me that would allow me to otherwise conclude SEB was, under any warranty, responsible for towing costs. 18. In summary, I find there is no proof that SEB misrepresented the E-Bike or breached the SGA implied warranties or any other warranties attached to the sale.

Lee v. Derbas - 2024 BCCRT 615 - 2024-06-27
Small Claims Decisions - Final DecisionShe seeks $5,000 to cover the replacement cost of these items and the cost of recovering her 2 vehicles from a tow yard. Mr. Derbas says the items were of little value and he incurred costs in disposing of them and cleaning up debris. [...] Ms. Lee also asks for the costs associated with recovering 2 vehicles that Mr. Derbas had towed from the RV park. 15. Mr. Derbas provided significant photo and video evidence relating to Ms. Lee’s conduct while residing at the RV park. [...] For conversion to apply, Ms. Lee must prove that Mr. Derbas’ act was “wrongful,” which means it must be unjust, unfair, or harmful: see Charbonneau v. Mundie’s Towing, 2008 BCPC 239 at paragraph 13. I find Mr. Derbas is essentially arguing that it was not wrong to dispose of Ms. Lee’s items because she abandoned them.

He says he has documentation from Canadian Tire that the engine and transmission were “beyond repair” and that the exhaust was rusted through. [...] The evidence before me contains a May 19, 2019 receipt for towing services and a Canadian Tire receipt for purchases of $13.42 but, as noted above, no report about the van’s condition. [...] There is no documentation from a mechanic or other technician as to the reason for the towing service, the status of the van, or the need for it to be scrapped.

It is undisputed that in June 2017 the respondent’s trailer caught fire and was damaged while the applicant’s truck was towing it. [...] The respondent arranged for the person driving the applicant’s truck to tow the damaged trailer to a nearby mechanic in Hope. The respondent says that mechanic told them the truck had air leaks which resulted in low air pressure which caused the trailer brakes to drag and catch fire.

Smith v. Wild Grizzly Transport LTD - 2018 BCCRT 203 - 2018-05-25
Small Claims Decisions - Final DecisionHe seeks a $1,500 refund, $140 for a vehicle inspection and $300 for towing the car when he discovered it could not be insured. 3. The respondent, through its principal Pasquale Zampieri, says the car was represented accurately, sold “as is” “non runner” with no warranties and as a final sale. [...] 13. The applicant filed text messages showing that both parties understood that, upon the respondent receiving payment, a tow truck would pick up the car and bring it to the applicant. Based on this evidence, I find that the applicant knew that the car was not running, prior to the transaction completing. [...] Both parties knew it would need to be towed, not driven, to its new owner. I find the respondent did not misrepresent the car.

In subsequent years, residents and council members disagreed about how or whether to enforce the 2011 parking rules. Dhesa v. ICBC - 2020 BCCRT 697 - 2020-06-24
Small Claims Decisions - Final DecisionAfter that, the parties communicated about the GST issue, but the records show ICBC requested the truck’s towing on February 15, 2019. ICBC’s tow request was only 11 days after Mr. Dhesa agreed to the total loss, a period I find reasonable. [...] As noted above, the accident occurred on November 20, 2018 and Mr. Dhesa chose to pursue repairs at least until February 4, 2019 and ICBC requested the truck’s towing 11 days later. Given these circumstances, I find Mr. Dhesa has not proved a loss related to the truck’s storage.
